Content and Intellectual Property Policy

This Content & Intellectual Property Policy applies to content uploaded, created, generated, or shared through ArtMyPlace, operated by ArtMyPlace OÜ ("ArtMyPlace", "we", "us", or "our").

This Policy forms part of our Terms and Conditions.

You may provide ArtMyPlace with images, photographs, reference materials, text, prompts, instructions, and other content ("User Content").

You retain any rights that you already hold in your User Content.

By providing User Content to ArtMyPlace, you confirm that you have the necessary rights, permissions, or other lawful basis to use that content for the requested purpose.

You remain responsible for the User Content you provide.

By submitting User Content, you grant ArtMyPlace the rights necessary to process, store, reproduce, modify, and transmit that content as reasonably required to provide and operate the requested ArtMyPlace services.

This may include providing User Content to technology and service providers involved in AI generation, image processing, storage, production, printing, and other functions necessary to provide the service.

This permission does not transfer ownership of your User Content to ArtMyPlace.

ArtMyPlace allows users to create artwork using artificial intelligence and other image-generation and image-processing technologies.

Subject to applicable law and any third-party rights, ArtMyPlace does not claim ownership of artwork you create through the service solely because it was created using ArtMyPlace.

You may use artwork created through ArtMyPlace for personal, non-commercial purposes, including saving, displaying, and sharing the artwork.

You may also use the artwork through functionality provided by ArtMyPlace, including ordering physical products and, where available, publishing or offering artwork for sale through the ArtMyPlace platform.

Unless expressly authorized by ArtMyPlace, artwork created through ArtMyPlace may not be used outside the ArtMyPlace platform for commercial purposes. This includes selling digital copies, selling physical reproductions, licensing the artwork to third parties, using it in commercial products or merchandise, or otherwise commercially exploiting it through another platform or service.

Additional commercial rights may be granted under separate Creator Terms or another agreement with ArtMyPlace.

Copyright protection and ownership of AI-generated content may vary depending on applicable law, the way the artwork was created, and the contribution of the user. ArtMyPlace does not guarantee that any generated artwork qualifies for copyright protection.

You may be able to upload photographs, artwork, or other images as references when creating artwork.

You must have the right or permission to use the reference material for the requested purpose.

Uploading an image to ArtMyPlace does not give you rights to intellectual property owned by another person.

You must not knowingly use ArtMyPlace to reproduce or create content that unlawfully infringes another person's copyright, trademark, privacy, publicity, or other rights.

If you upload photographs or other content depicting identifiable people, you are responsible for ensuring that you have an appropriate legal basis or permission to use those images where required by applicable law.

You must not use ArtMyPlace to misuse another person's image or identity or to create unlawful, deceptive, abusive, or otherwise prohibited content involving another person.

AI-generated results may be similar to existing works or to content generated for other users.

ArtMyPlace does not guarantee that generated artwork is unique or that identical or similar content has not previously existed or will not subsequently be generated.

You are responsible for assessing whether your intended use of generated content may affect the rights of third parties.

You may not use ArtMyPlace to upload, create, publish, or distribute content that:

Is unlawful or promotes unlawful activity
Infringes intellectual property or other rights of third parties
Violates another person's privacy or publicity rights
Is fraudulent, deceptive, or intended to impersonate another person unlawfully
Contains child sexual abuse or exploitation material
Promotes terrorism or violent extremist activity
Contains unlawful threats, harassment, or exploitation
Is otherwise prohibited by applicable law

We may refuse to process, remove, restrict, or prevent access to content where we reasonably believe it violates this Policy, our Terms and Conditions, or applicable law.

Artwork you create is not automatically made public solely because it was created through ArtMyPlace.

Where ArtMyPlace provides functionality allowing you to publish, share, or offer artwork for sale, you choose whether to use that functionality.

Additional terms may apply when artwork is made publicly available or offered for sale.

Where ArtMyPlace allows users to offer artwork for sale, separate Creator Terms apply.

The Creator Terms may govern matters including eligibility, publication, licensing, production, sales, commissions, creator earnings, payments, taxes, and removal of artwork from sale.

Offering artwork for sale through ArtMyPlace does not transfer ownership of your underlying User Content to ArtMyPlace except for the rights expressly granted under the Creator Terms.

The ArtMyPlace name, brand, website, software, interface, designs, logos, technology, and materials provided by ArtMyPlace are owned by or licensed to ArtMyPlace OÜ.

You may not copy, distribute, modify, sell, license, or commercially exploit these materials except where expressly permitted by ArtMyPlace or applicable law.

If you believe that content available through ArtMyPlace infringes your copyright, trademark, or other intellectual property rights, please contact us at support@artmyplace.com.

The protected work or right
The content you believe infringes that right
Where the relevant content can be found on ArtMyPlace
Your contact information
The basis for your claim

We may request additional information where reasonably necessary to review the complaint.

Where appropriate, we may remove or restrict access to the relevant content while the matter is reviewed.

We may restrict, suspend, or terminate access to ArtMyPlace where a user repeatedly or seriously violates intellectual property rights, this Policy, our Terms and Conditions, or applicable law.

We may update this Policy from time to time to reflect changes to our services, technologies, or legal requirements.

The current version will be published on ArtMyPlace with the date of the latest update.
