Creator Agreement & Terms

These Creator Terms supplement and form an integral part of our General Terms and Conditions, Content and Intellectual Property Policy, and Creator Reward and Payout Policy. By completing Creator Onboarding or enabling On Sale for any artwork, you confirm that you have read, understood, and agreed to be bound by these Creator Terms.

ArtMyPlace provides an online platform and marketplace enabling creators to showcase digital artworks and offer them for purchase as high-quality physical prints, canvases, and framed wall art to buyers worldwide.

When you list an artwork On Sale, you authorize ArtMyPlace to display, promote, manufacture, package, and deliver physical reproductions of that artwork to purchasing customers.

ArtMyPlace acts as the merchant of record for customer transactions, handling order intake, payment processing, manufacturing through certified print partners, worldwide fulfillment, customer support, returns, and applicable value-added tax (VAT) collection.

To register as a Creator and sell artworks on ArtMyPlace, you must satisfy all of the following eligibility criteria:

• You must be an individual natural person aged 18 years or older.
• You must be a permanent and lawful resident of a member state of the European Union (EU).
• You must hold an active ArtMyPlace Pro subscription at the time of onboarding and throughout the period your artworks remain On Sale.
• You must complete the Creator onboarding process and provide accurate, current, and verifiable legal and residential details.

Corporate entities, commercial partnerships, self-employed business entities, and creators residing outside the European Union are not eligible in this version of the Creator program.

If your Pro subscription expires, is cancelled, or is downgraded, your ability to place new artworks On Sale will be paused until your subscription is renewed.

Ownership: You retain all copyright, moral rights, and any other intellectual property rights that you own in your original artworks and user content. ArtMyPlace does not claim ownership of your artworks.

License Grant: By enabling On Sale for an artwork, you grant ArtMyPlace a non-exclusive, worldwide, transferable, sublicensable, royalty-bearing (subject to Creator Rewards) license to reproduce, digitally display, distribute, resize, crop, color-calibrate, print, frame, package, and advertise the artwork solely for the purposes of operating the marketplace, fulfilling buyer orders, and marketing the ArtMyPlace platform.

Warranties and Representations: For every artwork you place On Sale, you warrant and represent that:

• You are the original creator of the artwork or hold all necessary legal rights and licenses to grant the permissions specified herein.
• The artwork and all underlying source materials, prompts, and reference images do not infringe upon any copyright, trademark, trade dress, moral right, privacy right, publicity right, or other proprietary right of any third party.
• The artwork strictly complies with the ArtMyPlace Content and Intellectual Property Policy, including restrictions on defamatory, hate speech, unlawful, or sexually explicit content.

Before enabling On Sale for any individual artwork, you must explicitly accept the mandatory per-artwork legal confirmation taking legal responsibility for the artwork and source materials.

You configure selling options, available product formats, and size options for your artworks via your ArtMyPlace dashboard.

ArtMyPlace establishes the final retail prices displayed to customers, which account for fine art print production, archival framing, secure packaging, shipping, payment gateway processing fees, customer care, and your Author Reward.

ArtMyPlace reserves the right, in its sole discretion and without prior notice, to review, unpublish, refuse to produce, or permanently remove any artwork from the marketplace that violates these terms, infringes third-party rights, or does not meet print production quality thresholds.

You may unpublish an artwork from On Sale at any time. Any orders confirmed prior to unpublishing will be honored, manufactured, delivered, and rewarded in accordance with these terms.

When a customer purchases a physical copy of your artwork, you earn a Creator Reward ("Author Reward") in EUR as determined by your artwork sell settings and our Creator Reward and Payout Policy.

All reward accounting, statutory holding periods, minimum payout thresholds, and disbursement procedures are governed by the Creator Reward and Payout Policy.

You may list artworks On Sale upon completing the initial selling setup. However, to receive payouts of accumulated Creator Rewards, you must complete the Payout Setup and obtain "Verified" Creator Profile status.

Payout Setup requires providing:
• Full legal residential address (street address, city, postal code, EU country);
• Primary country of tax residence and valid Tax Identification Number (TIN), along with any secondary EU tax residence;
• SEPA bank account details (account holder name matching legal name, EUR IBAN, and BIC where applicable);
• Confirmation of document acceptances and accuracy of submitted details.

DAC7 European Tax Reporting: Pursuant to European Council Directive (EU) 2021/514 ("DAC7"), ArtMyPlace OÜ is legally required to collect, verify, and annually report seller identification, tax residence, TIN, bank details, and total marketplace sales revenues to the Estonian Tax and Customs Board (Maksu- ja Tolliamet / EMTA) for automatic exchange with the tax authorities of other EU member states.

You remain independently responsible for assessing, filing, and paying all personal income taxes, social security contributions, and local levies arising from Creator Rewards in your country of tax residence.

ArtMyPlace reserves the right to immediately suspend selling privileges, withdraw artworks from sale, withhold pending or available payouts, or terminate your Creator account if:

• You breach any provision of these Creator Terms, our General Terms, or the Content and Intellectual Property Policy;
• You provide inaccurate, forged, expired, or deceptive identity, residential, tax, or banking details;
• We receive repeated or substantiated notices of copyright or trademark infringement regarding your artworks;
• Unusually high rates of customer disputes, cancellations, or fraudulent transactions are detected;
• Required by applicable statutory law, court decree, or tax authority direction.

If your Creator Profile status is changed to "Suspended", both sales and payouts are blocked until resolution.

ArtMyPlace may amend these Creator Terms to accommodate legal developments, regulatory mandates, or platform enhancements.

The updated version will be posted on ArtMyPlace with the revised version date. Where required by applicable law or platform policy, we will notify creators in advance of material amendments, and you may be prompted to review and accept the revised terms upon signing in.

These Creator Terms, their interpretation, and any disputes or claims arising out of or related to your activities as a Creator on ArtMyPlace are governed exclusively by the laws of the Republic of Estonia, excluding its conflict of law principles.

Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Harju County Court (Harju Maakohus) in Tallinn, Estonia. If you are acting as a consumer, this choice of law and venue does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence.
